Does Justice Depend Upon Party and Race?

You may have heard that nine people were charged with illegally accessing President Obama’s educational loan applications. The charges were brought by the U.S. Attorney’s office.

You probably have not heard that there were eight separate incidents of Ohio officials illegally accessing numerous state files on Joe Wurzelbacher. The U. S. Attorney’s office was conspicuously absent from this law suit. In fact, the state attorney’s office was defending these three individuals that accessed Joe Wurzelbacher’s files with no legitimate purpose.

U.S. District Judge Algenon L. Marbley (http://www.ohsd.uscourts.gov/judges/jmarbley.htm) dismissed the case saying “"Without allegations of a more specific and concrete nature as to the harms he suffered, (Wurzelbacher) does not meet the constitutional threshold required to state a claim for First Amendment retaliation."

The apparent differences are: Joe Wurzelbacher is a white Republican, the wrong doers in his case were state employees (which make it even more wrong in my eyes), the wrong doers were the same race as Judge Marbley but different from Joe Wurzelbacher.

Am I missing something or is this just WRONG. Am I seeing racial discrimination that does not exist? Is media bias spreading into our system of jurisprudence?

I believe there is some basis in fact in what you say, this Justice Department, had no problem dismissing the case against the NBP, the voter registration issue in Missouri yet the Joe the Plumber case gets dismissed. It's said perception is everything. More and more the perception is the DOJ is prejustice. The question, TBD is it just perception or is it fact.

    Maybe with a new Congress, and a different range of possibilities if they don't cooperate with investigations into their actions, DOJ will become more open about how and why it is and isn't pursuing certain cases.

    Meantime, I'm hesitant to get into race based opinion without facts.

    BTW, I've got a rapidly filling file of comments I can't publish.. the commenter does not share with your opinion about false accusations of racism, if nothing else he's made that "obscenely" clear in his hate speech.

  2. Nope, you are not missing anything. Evidence of their Racist tendencies came to light early by the mere fact that he sat in a Racist church for 20 years. Then the writing was on the wall when this Admin fired that Fed. official for exposing the misappropriation of Federal funds by Sacramento Mayor Kevin Johnson. Their Racist tendencies also were spotlighted when he called the Cambridge Police Dept. Racist. Also to DOJ refusing to even investigate those thugs in Philly of voter intimidation, and later inciting to riot. Yes, this is Racism and Bigotry at its finest. This gang has set back Civil Rights about 40 years.

  3. I too am hesitant to cry racism - but I am hard put to find any other logical justification. Racism or party-ism and both are wrong, wrong, wrong.
